La notion de " temps de travail effectif " - notion d'actualité remontant à la loi de 1841 relative à la durée du travail des enfants - peut être interprétée selon deux conceptions différentes. D'un côté, dans la conception que l'on peut appeler " productiviste ", est pris en compte le temps correspondant à un travail productif pour l'employeur. De l'autre côté, dans la logique du " travail au temps ", le temps pendant lequel le salarié doit se tenir à la disposition de l'employeur constitue le critère déterminant. Ces deux logiques ont émergé et se sont développées de façon parallèle, et coexistent actuellement. Dans le cadre de la logique productiviste, dominante jusqu'aux années 1990, des atténuations et même des entorses ont été apportées à cette logique qui a ainsi été rapprochée de la logique du travail au temps sur certains points. De même dans le cadre de la logique du travail au temps, qui constitue aujourd'hui le principe, il subsiste des exceptions et des entorses relevant de la logique productiviste. Or, selon que l'une ou l'autre conception est appliquée, le calcul de la durée du travail n'est pas le même, ce qui a pour effet une variation dans l'étendue de la protection du salarié contre des durées de travail excessives.
